The Most Common Questions About Personal Injury Lawsuits Revealed

If you’ve ever been hurt or injured as a result of someone else’s negligence, gross negligence, reckless conduct or intentional misconduct, you might be able to claim damages. These damages – otherwise known as compensation – can cover the cost of any medical bills and compensate for the pain you’ve suffered or limitations that you may now face as a result of the injury. Personal injury claims often involve road traffic accidents, work accidents (such as tripping or health hazards), medical negligence, assault and product liability where a faulty product has caused harm to a user. We’ve found answers to some of the most common questions that people ask about personal injury lawsuits so that you can decide whether you’re able to make a claim or not!

    Do I Have A Case?

This is the most common question ever thought or asked by potential claimants, as they aren’t sure if their personal injury incident counts as a valid claim. You can ask yourself some questions to determine whether you have a case or not. Start by reflecting back on the situation where you were injured and decide whether it is possible to prove that it was indeed caused by another person. If you are able to prove that someone else caused you significant compensable damages or losses – like lost wages, property damage, pain and suffering – you do indeed have a valid case. If you’re looking for advice on whether you have a claim for a personal injury lawsuit, Schuler, Halvorson, Weisser, Zoeller & Overbeck P.A are able to offer free case reviews. This is an excellent way to find out whether your case is worthwhile.

How Long Do I Have To File A Case?

Whilst different states have different rules, most courts detail that you must file a claim within two years of when the accident occurred. If your injuries or losses were not obvious on the same day as the accident occurred, the ‘discovery rule’ applies. This allows the two-year time limit to begin from when the day your injuries were found, rather than the date of the accident.

    Do I Need A Lawyer?

Not every case will require a lawyer, but if you do decide to file a claim without a lawyer, consider that this means that you are responsible for managing, researching and filing the claim. This isn’t an easy feat for individuals without previous experience or legal knowledge. It is in your best interest to hire a lawyer since they will do everything they can to increase the chances of you winning a claim. They will investigate, gather evidence to support your claim, and work directly with the insurance company on your behalf.

Whether your question has been answered or not, you’re now in the position to take the next step towards making a personal injury claim. Find a personal injury lawyer that specializes in your claim area, so that you can guarantee that you’ll be backed by someone who knows what they’re talking about. Have confidence in yourself and receive the justice that you deserve.
