I know everyone is eager to find out “what to do when…” situations arise, so I’ll get straight to the point with some advice. While every case is unique, these tips generally apply to most situations.

What Should You Do If You Are Pulled Over?

Here’s the best advice I can offer: If possible, avoid drinking and driving. Below, you’ll find a list of steps to follow if you’re pulled over in Florida.

First, it’s wise to keep your registration and insurance in an easily accessible spot in your vehicle. This way, you won’t have to search for it during a stop, which could be mistakenly seen as a sign of impairment.

Be polite to the officer. Being rude or difficult only increases the chances of going to jail or, worse, receiving an additional charge such as resisting an arrest without violence.

Be cooperative but cautious when asked for information. Provide your basic details like your name, address, and contact information. But, stop there. As a former prosecutor, I’ve seen that sticking to basic information works best in court.

Do not answer questions beyond the basics, especially queries like “Where are you from?” or “What have you been drinking?”

If asked to perform tests, remember, you are not legally required to take them.

If the officer asks, “Can I search your car?” always respond with “No.” They need a legal basis to do so, and by consenting, you waive your rights.

Regarding field sobriety tests, my advice is not to take the test until you consult with an experienced lawyer. However, be aware that if you have previously refused these tests, another refusal could be considered an additional offense.

If you’re concerned about losing your license for refusing a breathalyzer test, know that such refusal might lead to further penalties.

Finally, DO NOT plead guilty at your first court appearance if you have been arrested. Always consult with an experienced attorney first. You might have defenses available that could significantly impact your case if you plead not guilty.
