    When to Sue for an Injury

    Americans face risks in their daily lives, whether they are working, playing, driving or even walking down the street. The accidents that do occur in these and other areas often result from the negligent actions of others, in which case the victims may wish to seek monetary damages to compensate for their injuries.     The Types of Personal Injuries

    A personal injury is known as a tort. This differs from a criminal offense, which is prosecuted by a government entity. In a personal injury case, the victim, or plaintiff, will seek damages from the guilty party, or defendant, in a civil court setting. Personal injuries stem from many different circumstances, including:

    • Slips and falls

    • Workplace mishaps

    Determining Responsibility After an Accident

    Americans have a certain responsibility, or duty of care, to their fellow citizens. Unfortunately, many often violate this principle. Motorists may drive while texting or while under the influence of alcohol. Products may be built and sold that present hazards to their users. Health care professionals may make mistakes while administering drugs or providing other medical services. At work, equipment may not be adequately maintained or properly handled. The victims of these negligent acts may require financial assistance to deal with their injuries, but may also face confusion about their course of action.

    In some cases, such as a minor traffic accident, the victim may consider seeking compensation directly from the guilty party. When the damages are more extensive, private insurance may provide the needed compensation.
