    • Irreconcilable differences

    The court accepts and considers it as an irreconcilable difference if the couple is:

    • having no minor children
    •  living separately and apart for two years
    • without cohabitation

    • Impotence
    • Adultery
    • Conviction of a felony and imprisonment
    • Alcoholism and/or drug addiction
    • Wife is pregnant by another at the time of marriage without the husband’s knowledge
    • Malicious and willful desertion for one year
    • Bigamy
    • Violence to the extent of endangering the life of the spouse
    • Conviction of an infamous crime
    • Refusing to move to Tennessee with a spouse and willfully absenting oneself from a new residence for two years
    • Cruel and inhuman treatment or unsafe and improper marital conduct
    • Humiliation and Indignities that make the spouse’s life intolerable and
    • Abandonment, neglect, or banning the spouse from the home

    Apart from above the spouse desirous of divorce must be a resident of Tennessee when the grounds for divorce arose.

     In cases where the grounds for divorce arose outside of Tennessee, at least one of the spouses should have been a resident of Tennessee, prior to filing for divorce.   

    Custody of the children in Tennessee

    Sole or joint custody of child is awarded according to the best interests of the child. 

    The court also gives consideration to the child’s preference.

    Spousal Support in Tennessee

    Though Tennessee favors rehabilitative support yet spousal support may be taken in the form of a lump sum or periodic support. 

    The court may grant long-term alimony when rehabilitative support is not possible.

    Like other states of USA, Tennessee is also an equitable distribution state that judicially defines separate property of each spouse retained by that spouse.

    • Acquired prior to marriage;
    • By gift or inheritance;
    • In exchange for any separate property, or
